1 · What this is about

Kinderspiel is a free app that shows playgrounds and lets families contribute photos, reviews and missing places. By using it you accept these terms. The App Store's terms apply additionally to purchase and installation.

2 · ⚠ What this app cannot do

The details about playgrounds come from open data sources and from other users. We do not check them for accuracy, completeness or currency.

This expressly concerns:

  • the condition of the equipment. A swing listed in the app may be broken, removed or closed off.
  • the safety of a place. We make no statement about whether a playground is safe, clean, fenced or suitable for a particular age. Details such as "fenced" or "from age 3" are notes from other families, not test results.
  • access and admission. A place may be private, closed or subject to a charge, even if it says otherwise here.
  • photos. They may be years old.

Supervising your child remains your responsibility. No detail in this app replaces looking for yourself, on site.

3 · Your account

You can use the app without an account. On first launch a guest account is created so that favourites and contributions belong to you. If you sign in with Apple, Google or email, they stay with you on a new device as well.

You are responsible for your account. One account per person; accounts are not passed on. We may block an account if it breaches these terms.

Two accounts cannot be merged. Contributions stay with the account they are attached to.

4 · Your contributions

The rights to your contributions stay with you. Your photo stays your photo: you can go on using it yourself, publishing it and making it available to other services as well. We claim no exclusivity.

So that we may show your contribution, submitting it grants us a simple — that is, non-exclusive — right of use, unlimited in space and time and royalty-free, in photos, reviews, descriptions and details about places. It covers the right to store them, reproduce them, adjust their size and format, translate them, make them publicly available and use them to promote Kinderspiel — in the app, on kinderspiel.app, in later versions of the app and in our own advertising. We may transfer it to third parties and grant sublicences in so far as that serves the running of Kinderspiel.

We keep contributions and images — even if you delete your account. Photos, reviews and playgrounds you added that are already published stay visible; they are part of a map that other people rely on. They are merely detached from your account, so that they can no longer be attributed to you (section 8 and the privacy policy).

If you withdraw a single contribution, we take it out of the app. For uses that had already taken place before that — an image in printed advertising, say, or in an App Store listing — the right remains; those we cannot call back.

You warrant that you hold the necessary rights: that you took the photo yourself or are allowed to use it, and that no third-party rights are infringed.

No photos in which people are recognisable — least of all children. Photograph the place, not the people on it.

Every contribution is reviewed before publication. We may reject, hide or remove contributions if they breach these terms or are obviously wrong. There is no entitlement to publication.

5 · What is not allowed

  • insults, hate, advertising, spam, political messages
  • photos of recognisable people, children in particular
  • false details, invented places, deliberately false reviews
  • other people's content without the right to it
  • automated extraction of the data, rebuilding the dataset, circumventing the technical protection measures
  • trading or manipulating points or accounts

6 · Points and leaderboard

Approved contributions earn points, and a public leaderboard arises from them. Points have no monetary value, are not transferable, cannot be paid out and give rise to no entitlement. We may change the calculation if it would otherwise become unfair — that has already happened once, in the summer of 2026.

You can take your name out of the public list in your profile.

7 · Supporting the app

The app is free and will stay free. You can donate voluntarily. In return you get a badge on your profile and see no advertising — no other additional features. There are no points for money.

Where and in what form the app shows advertising may change.

Apple handles the payment; Apple's terms apply. Refunds run through Apple, not through us.

8 · Availability and changes

We do our best to keep the app running, but owe no particular availability. Features may change or fall away. The app needs an internet connection and a current version of iOS.

You can delete your account in the app at any time. ⚠ Contributions already published remain visible, but are separated from your account — details in the privacy policy.

9 · Liability

We are liable only as far as we must be.

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. Under German law these cases cannot be excluded.

In cases of simple negligence we are liable only where we breach a material contractual obligation, and limited to the damage typical for such a contract and foreseeable. Otherwise our liability is excluded — on whatever legal ground. Liability under the German Product Liability Act remains unaffected.

No guarantee, no assurance. We give no guarantee as to the accuracy, completeness or currency of the details about playgrounds, and we do not assure that a place is safe, open, clean or suitable for a particular age. What that means is set out in section 2.

For the loss of contributions, photos or points we are liable only under the sentences above. We owe you no backup of your data — keep photos that matter to you on your own device.

Claims against us become time-barred after one year, unless one of the cases of unlimited liability named above applies or the law mandatorily prescribes a longer period.

We are not liable for content contributed by other users; we remove it as soon as we become aware of an infringement.

10 · Third-party data and sources

  • For places without a photo of their own we show an image from Google Places, including the name of the person who took it. It belongs to Google and to the author, not to us.

11 · Reports

Any content can be reported in the app. We look at reports and decide; we cannot promise a deadline. You can also report unlawful content directly to hallo@kinderspiel.app.

12 · Changes to these terms

We may change these terms where there is an objective reason to do so. We will give notice of material changes in the app. The version in force at any given time is at kinderspiel.app/terms, with a date.

13 · Final provisions

German law applies; mandatory consumer protection provisions of your country of residence remain unaffected. If a provision is invalid, the remainder stays effective.
